“The Legal Evolution of Educational Reform in the Past 25 Years and the Impact of Decisions at the Local and National Level

Today’s Institute focuses on the evolution of educational reform over the past 25 years with respect to both the financial and political impact based upon landmark decisions and public policy changes at the local and national level.  MASBO is privileged to have as its keynote speaker Attorney Stephen J. Finnegan. Attorney Finnegan was intimately involved in organizing and moving forward the legal strategy for education reform. His work assisted in the development of a plan and strategy which ultimately led to “McDuffy and Others v. Secretary of the Executive Office of Education and Others”. Attorney Finnegan also co-authored and submitted a brief to the Supreme Judicial Court to assist the court in its deliberation in the McDuffy action. Attorney Finnegan currently serves as legal counsel to the Massachusetts Association of School Committees.

 

MASBO is honored once again to have Attorney Joseph Bartulis address the group. A frequent contributor to the organization, Attorney Bartulis will speak to the impact of decisions both here in the Commonwealth and in Washington, DC and how they affect our work environment.

Our third presenter today is Attorney Kimberly Rozak of Mirick and O’Connell. Attorney Rozak is a partner in the firm’s Labor, Employment and Employee Benefits Group.  She is counsel to a number of school districts across the Commonwealth.

9:15 a.m. – 10:15 a.m.      McDuffy and Others v. Secretary of the Executive Office of Education and Others”

Presenter: Mr. Stephen Finnegan, Esq., Counsel to Massachusetts Association of School Committees

Attorney Finnegan will retrace the activity which lead to the landmark decision focusing on his particular activity in this litigation. He will also review the end result 25 years later and offer thoughts on how that decision (and subsequent decisions such as Hancock) may impact future litigation.

10:30 a.m. – 11:30 a.m.    Managing a Changing Workplace: The Trump Effect, Pot and More    

Presenter:   Mr. Joseph Bartulis, Esq., Fletcher and Tilton

Attorney Bartulis will present a number of important topics including the Trump Administration’s impact on employment laws and regulations, Massachusetts Pay Equity Act for 2018 – What to Do Now? And Recreational Marijuana Legalization in MA and Workplace implications.

 

11:30 a.m. – 12:00 p.m.     Ask the Experts.” This session will be a panel discussion that will feature Attorney’s Finnegan, Bartulis and Kim Rozak of Mirick

                                        O'Connell.  They will have received questions submitted in advance by the membership prior to today's presentation.  This session

                                        will also feature a select number of questions which will be taken from the audience.

1:00 p.m. – 2:00 p.m.        Governance Issues under Education Reform and What Business Managers Should Know?”

Presenter: Ms. Kim Rozak, Esq., Mirick O’Connell

Attorney Rozak will discuss contracts that the superintendent can enter into without School Committee approval, and contracts that require the School Committee authorization. Attorney Rozak will also discuss terms of contracts (such as renew clauses, and termination clauses) which can impact District finances.  She will also speak about terms contracts to insure a District is financially protected.
